DWOP in Cause No. 2020-20109; Anh To Au v. Glenda Harris; in the 61st District Court (5/10/2021)

On March 30, 2020, Plaintiff’s Original Petition was filed by Attorney Norman K. Husain, of the firm Husain Law + Associates, P.C., on behalf of Plaintiff, Anh To Au, who alleged that on June 23, 2018, a motor vehicle accident was caused by the negligence of Defendant, Glenda Harris, and that Plaintiff suffered personal injury as a result. The case was styled Cause No. 2020-20109; Anh To Au v. Glenda Harris; in the 61st District Court of Harris County, Texas, Hon. Fredericka Phillips Presiding.

On November 20, 2020, the Court sent a notice advising that the case would be dismissed for want of prosecution unless a verified motion to retain was filed and heard by February 4, 2021.

On January 8, 2021, Plaintiff’s Verified Motion to Retain was filed, and a notice of written submission was filed on the same day setting submission for January 18, 2021. The Motion to Retain argued that the Court should retain the case on the docket because the process server was still in the process of serving the Defendant.

On February 1, 2021, the Court sent a Notice of Intent to Dismiss advising that the case would be dismissed for want of prosecution if a motion for default judgment were not filed and heard by May 3, 2021, or an answer were not filed by the same date.

On May 10, 2021, the Court dismissed the case for want of prosecution.
